The Committee on Judiciary moved to amend the bill by striking out the title and substituting therefor a new title, to read as follows:

Eng. Senate Bill 615—A Bill to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §55-7-32, relating to limitations on actions related to certain electric generating facilities designated as exempt wholesale generators under federal law; defining terms; providing that construction and commercial operations of a qualified facility shall not constitute or give rise to a covered claim; prohibiting covered claims against siting certificate holders or operators of qualified facilities unless certain criteria met; providing limited exception to prohibition against covered claims; requiring that acts or omissions of siting certificate holder giving rise to noncompliance be proximate cause of covered claim; providing exception for certain personal injury and property damage claims; and providing for prospective effect.
